How Benson Got Handcuffed in Court & Landed Behind Bars on SVU: “My Duty Is…”

Benson doesn’t play when it comes to protecting survivors, as seen in SVU‘s latest courtroom showdown.

Law & Order: Special Victims Unit icon Captain Olivia Benson (Mariska Hargitay) will jump through endless hoops for survivors, and that steadfast dedication landed her in handcuffs during Season 27’s “Impropriety.”

Whether it’s a gruesome murder scene or a traumatized victim grappling with showing up to court, Benson’s infallible empathy with survivors has long been a hallmark of the NBC nail-biter. Benson has a knack for encouraging survivors to open up and seek help, with the SVU Captain often emboldening them to help the squad secure justice by the trial’s end. Benson’s cherished compassion was firing on all cylinders during SVU’s April 30 episode “Impropriety” after a teenage girl named Emma was dumped outside of a hospital after being assaulted. The SVU soon found themselves wrangling a crew of teenagers from the ill-fated party where the assault took place.

Here’s what happened in SVU’s “Impropriety,” and how it led to Benson being tossed behind bars.

Benson made a promise to a survivor on Law & Order: SVU

Through the SVU’s steadfast investigation, they eventually learned that Emma had been drugged with lorazepam. After Emma woke up in the hospital, she told Benson that if she’d hooked up with her crush, Matt, it wouldn’t have been sexual assault. The problem was that both Emma and Matt had the same drugs in their system, unveiling a larger conspiracy afoot. Matt and Emma had no recollection of the night or their hook-up, despite neither taking any drugs nor drinking very much.

Benson soon learned from Emma that the teens had been partying at their peer’s house, and that the mother, Talia, had provided the drinks and the party location in hopes of keeping the kids safer. But once Benson discovered Talia had been drinking with the minors and had even encouraged Emma to hook up with Matt in her own guest room, alarm bells began ringing.

During her digging, Benson connected with Emma over an incident of sexual abuse that occurred when she was a child. Benson offered to get Emma some help, but after Emma panicked, she asked Benson to promise to keep the incident a secret. Benson swore to keep Emma’s secret safe with her.

Meanwhile, a search warrant revealed that Talia had planted a hidden camera facing the bed in the guest room and had a stash of lorazepam in her medicine cabinet. Talia had drugged the teenagers, then secretly filmed them after sexually manipulating them. Despite Talia’s deplorable actions, Talia was the daughter of a retired NYPD judge, so the squad was staring down a complicated trial.

Benson was handcuffed after refusing to break a promise

As soon as the case hit the courtroom, Benson and A.D.A. Sonny Carisi (Peter Scanavino) were in for a doozy of a trial. Talia’s connections within the NYPD courts definitely deterred the squad’s progress as Peter Hermann’s iconic D.A. Trevor Langan poked holes in the victims’ testimony. The worst moment occurred after Langan went after Emma’s credibility, asking Benson if the victim had a history of sexual abuse.

Due to her former promise to Emma, Benson was effectively compromised, telling Langan and the judge that she couldn’t answer the question. Carisi attempted to redirect the questioning, but Langan and the judge doubled down, demanding Benson answer the question lest she be held in contempt of court.

“My duty is to protect the victim,” Benson maintained. “I can’t and won’t answer the question.”

Benson was tossed in handcuffs and quickly thrown behind bars for her resilience. Carisi swiftly pulled some strings to allow Emma to visit Benson, and she tearfully confessed to previously telling Talia about the sexual abuse. Talia was now leveraging whatever she could against her, so Emma now wanted to testify to take her down.

Benson was subsequently released, and Emma’s testimony was powerful enough to sway the jury back toward justice. Talia was found guilty on all charges, but Benson’s headache was far from over. After returning to the precinct, Benson was floored after her boss, Chief Kathryn Tynan (Noma Dumezweni), arrived to let her know she was immediately suspended due to her actions in the courtroom. An NYPD Captain being found in contempt of court was unacceptable, and Benson was to surrender her badge immediately.

Between being tossed in handcuffs and forfeiting her badge, Benson has been kept on her toes this season, and we can’t wait to see how she navigates this turmoil as Season 27 reached a climactic boiling point.
